Terms & Conditions
By using Setapp ("the service"), you agree to these Terms & Conditions. If you do not agree, please do not use the service.
1. The service
Setapp is a hospitality management platform that includes Booking, Spa, Restaurant / POS, Housekeeping, Technical, Cashbox, Bank, Credit, Finance, Reports, Statistics, Guests, Inquiry and Print modules — together with related infrastructure, integrations and support.
2. Your account
To use the service you must register an account. You are responsible for keeping your account credentials safe and for all activity under your account. Notify us immediately if you suspect unauthorised access.
Each property is a separate workspace. Multi-property customers may have one billing entity governing several workspaces.
3. Acceptable use
You agree not to:
- Use the service for anything illegal or in violation of any applicable law
- Attempt to break, reverse-engineer, copy or interfere with the service
- Resell, sublicense or grant access to third parties without our written agreement
- Upload content that violates anyone's rights, including intellectual property or privacy
- Bypass rate limits, security measures or access controls
- Use the service to send spam or unsolicited communications to guests or third parties
4. Customer data ownership
Your data is yours. You retain all rights and ownership of the data you upload or generate in the platform. You can export it at any time, in standard formats, while your subscription is active.
We process your data only to provide the service, as described in our Privacy Policy, and only on your instructions.
5. Cancellation & termination
You can cancel your subscription at any time from your account settings or by contacting us. Cancellations take effect at the end of your current billing cycle. Fees already paid are not refundable except where required by law.
We may suspend or terminate your account if you breach these terms, fail to pay, or use the service in a way that risks the platform or other users.
6. Service availability
We aim for 99.9% uptime but do not guarantee uninterrupted service. We will communicate planned maintenance in advance whenever practical.
Premium customers receive a separate Service Level Agreement (SLA) with explicit uptime targets, response times and service credits.
7. Updates to the service
We continuously improve the platform. New features, fixes and adjustments are deployed regularly. We may add, modify or remove features at our discretion. Material changes will be communicated through the platform or by email.
8. Intellectual property
The Setapp platform — software, brand, designs, documentation — is owned by us and protected by copyright, trademark and other laws. These terms grant you a limited, non-exclusive, non-transferable right to use the service while your subscription is active. Nothing in these terms transfers any intellectual property to you.
9. Liability
To the maximum extent allowed by law, Setapp's total liability for any claim under these terms is limited to the fees you paid us in the 12 months immediately before the event giving rise to the claim. We are not liable for indirect, consequential, incidental or punitive damages, or for lost profits or revenues.
You are responsible for the legal compliance of how you collect and process guest, staff and financial data on the platform.
10. Indemnification
You agree to defend and hold us harmless from claims arising out of your use of the service in violation of these terms or applicable law, or from content you upload to the platform.
11. Confidentiality
Both parties agree to keep confidential any non-public information shared in connection with the service, except as required by law or with the other party's written consent.
12. Governing law
These terms are governed by the laws of the Republic of Azerbaijan. Any dispute that cannot be resolved between the parties will be submitted to the competent courts of Baku, Azerbaijan, unless a different jurisdiction is required by mandatory consumer protection law.
13. Changes to these terms
We may update these terms over time. Material changes will be communicated by email at least 30 days before they take effect. Continued use of the service after the effective date constitutes acceptance of the updated terms.
